"Every shop needs a Gumasta." That stopped being true in Maharashtra — and most people haven't noticed.

Ask around in Pune and you will be told, confidently, that the first thing any new shop, office or business must do is get a "Shop Act licence" — the Gumasta. For decades that was right: under the old law, practically every establishment had to register. Then, on 1 October 2025, Maharashtra quietly changed the rule, and a large share of small businesses no longer need the registration certificate at all — they only need to tell the government they have started. Get this wrong in either direction and you either waste time chasing a certificate you do not need, or you skip an obligation you still have. Here is what the Shop & Establishment law in Maharashtra actually requires in 2026, who has to register, who only has to give intimation, and why plenty of businesses below the line still choose to register anyway.

What the Shop & Establishment law is for

The governing law is the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017, which replaced the old Bombay Shops and Establishments Act, 1948. Despite the "Shop Act" nickname, it is really a labour law: it regulates working hours, weekly holidays, leave, overtime, the employment of women and young persons, wages timing and general conditions of service for people working in shops, commercial establishments, hotels, eateries, theatres and other workplaces. Registering under it — the certificate people call the "Gumasta licence" — is how the state knows an establishment exists and holds it to those employment standards. It is separate from, and additional to, whatever you did to form the entity (a proprietorship, a partnership, or a company) — the entity is the business; the Shop Act registration is the establishment's licence to employ people at a premises.

The line that now decides everything: twenty workers

This is the part that changed, and it is the single most important thing to get right. Under the 2017 Act, whether you must register or merely give intimation depends on how many workers you employ:

  • Twenty or more workers → you must register. Under Section 6, an establishment employing twenty or more workers has to apply for a registration certificate from the Facilitator and hold that certificate. This is the full "Gumasta".
  • Fewer than twenty workers → intimation only. Under Section 7, an establishment employing fewer than twenty workers does not need a registration certificate. It only has to file an online intimation of commencement of business, with the basic details and documents, and keep the acknowledgement.

The threshold used to be ten workers. The Maharashtra Shops and Establishments (Amendment) Ordinance and Rules, 2025, in force from 1 October 2025, raised it to twenty as part of the state's ease-of-doing-business push — so a business with, say, twelve employees that would have needed a full registration certificate a year ago now only needs to give intimation. A great deal of online guidance still quotes the old ten-worker figure; in 2026 the operative number for the registration-versus-intimation split is twenty.

Two things founders routinely misread here. First, intimation is not exemption. If you are under the threshold you are still covered by the Act's employment rules — you simply do not hold a registration certificate; you still have to file the intimation. Second, "workers" means the count on which the obligation turns, so a growing team can cross the line: the day your headcount reaches twenty, the registration requirement switches on, and you should move from intimation to a registration certificate.

Why businesses below the line still register anyway

Here is the practical twist that surprises people: even establishments that only need to give intimation very often want the registration certificate, because in the real world it is treated as proof that the business exists. The Gumasta / Shop Act certificate is one of the most widely accepted documents for:

  • Opening a current account. For a sole proprietorship especially — which has no incorporation certificate of its own — banks routinely ask for the Shop Act registration as one of the proofs of business existence before they will open a current account in the business name.
  • KYC with landlords, marketplaces and payment gateways, who often want to see a registration in the business name.
  • General credibility — a displayed registration reassures customers and counterparties that the establishment is on the record.

So the honest position for a small business is: you may not be legally required to register below twenty workers, but you may still choose to, because the certificate opens doors that the bare intimation acknowledgement does not. That is a judgement call worth making deliberately rather than by default.

How you register (or give intimation)

The whole process is online, through the Maharashtra Labour Department's web portal — no queue at a municipal office. The shape of it:

  • Apply within sixty days of commencing business. Whether you are registering (twenty or more workers) or giving intimation (fewer than twenty), you are expected to do it within the period the rules prescribe after you start operating.
  • Submit the establishment's details and documents — typically the proprietor's / partners' / directors' identity and address proof, the establishment's PAN, proof of the premises (rent agreement or ownership document, and often an NOC), and details of the number of workers. The exact document set varies a little by category of establishment.
  • Pay the fee, which scales with the number of workers — a nominal amount for the smallest establishments, rising with headcount.
  • The Facilitator issues the certificate (for registration) or an acknowledgement (for intimation), which you download and display at the workplace.

How long it lasts, and renewing it

A Shop Act registration is not one-and-done, but it is not annual-only either. The employer can choose the validity period at the time of registration, up to a maximum of ten years, and pay the fee for that span. Before it expires, you apply to renew — the renewal application should go in ahead of the expiry date (typically at least thirty days before) so the certificate does not lapse. Picking a longer validity up front is usually the sensible move: it means one filing now instead of a renewal reminder every year.
